Texas uses proportionate responsibility. Tex. Civ. Prac. & Rem. Code § 33.001 bars recovery entirely if you are more than 50% responsible for the wreck. At exactly 50% you can still recover. At 51% you get nothing.

When the other driver’s policy is not enough
Texas requires drivers to carry only 30/60/25 — $30,000 per injured person, $60,000 per crash, $25,000 for property damage. Tex. Transp. Code § 601.072. An ambulance ride, an emergency room visit, and one MRI can consume most of $30,000 before anyone mentions surgery or missed work.
That is where your own underinsured motorist coverage does the heavy lifting. Texas insurers have to offer it in writing, and you have to reject it in writing to go without it. Tex. Ins. Code § 1952.101. Pull out your declarations page and look. A surprising number of people carry UM/UIM and never knew it.

Where Round Rock crashes actually happen

What to do in the first week

You are not required to, and we generally advise against it before you have talked to a lawyer. That adjuster works for the company paying your claim. The questions are friendly and the purpose is to lock in language about your injuries and your share of the fault while you are still sore, medicated, and guessing. You do owe your own insurer prompt notice under your policy.
