Survival Action

Definition: A survival action is the deceased person’s own personal injury claim, which under Texas Civil Practice and Remedies Code § 71.021 survives death and passes to the estate. The personal representative or heirs recover the decedent’s pre-death pain and suffering, medical expenses, and funeral costs.

Also called: survival claim, estate claim

What a survival action means in Texas

A survival action is the lawsuit the injured person could have filed had they lived. At common law a personal injury claim died with the plaintiff. Section 71.021 of the Civil Practice and Remedies Code changed that: a cause of action for personal injury to the health, reputation, or person of an injured person does not abate because of death. It survives to and in favor of the heirs, legal representatives, and estate.

The claim is the decedent’s, not the family’s. That distinction separates it from wrongful death, which compensates the surviving spouse, children, and parents for their own losses. The two claims are usually filed in the same petition but they have different plaintiffs, different damages, and different beneficiaries.

How it works in practice

The survival action is brought by the personal representative of the estate, meaning the executor named in a will or the administrator appointed by a probate court. Travis County probate matters are handled by Probate Court No. 1 on Guadalupe Street. If no administration is pending and none is needed, the heirs may bring the claim themselves, though they must plead and prove that status.

Recoverable damages are what the deceased suffered between injury and death: conscious physical pain and mental anguish, medical expenses, lost earnings during that period, and funeral and burial costs. Where death was instantaneous, the pain and suffering component may be small or contested, and the fight centers on whether the person was conscious. Any recovery becomes an estate asset and passes under the will or the intestacy statutes, which can route money to people who are not wrongful death beneficiaries. The two-year statute of limitations applies.

Why it matters in your case

The survival action captures losses the wrongful death claim cannot, including the hospital bills that would otherwise fall on the estate and the suffering of a person who lived for days or weeks after a crash. Because the recovery passes through the estate, creditors and the terms of a will shape who ends up with it. Opening an estate early avoids standing fights with the defense later.

Example

Robert is struck by a pickup while cycling on South Congress and dies nine days later in the ICU. His daughter is appointed administrator of his estate and brings a survival action for his $210,000 in medical bills, funeral costs, and nine days of conscious pain. She and her mother separately bring wrongful death claims for their own losses. Both claims are tried together in Travis County district court.

Frequently asked questions

Who can file a survival action in Texas?

The estate's personal representative, meaning the executor or court-appointed administrator, has the primary right. If no estate administration is pending or necessary, the heirs at law can file, but they must plead and prove that no administration is needed. Defendants frequently challenge standing when the estate has not been opened.

Can a survival action recover damages if the person died instantly?

Medical and funeral expenses are recoverable regardless. Pain and suffering requires evidence that the person was conscious for some period before death, even briefly. When death is truly instantaneous, that component is usually unavailable, and the family's compensation comes mainly through the wrongful death claim.
