Texas does not use the word ‘custody’ the way most parents expect — it talks about conservatorship, rights, and duties. If you are facing a custody question in Buda, SMB Law, PC explains what those terms actually mean for you and your child. A Buda child custody lawyer can translate conservatorship, possession, and access into what they actually mean for your time with your child. Shane M. Boasberg has handled Central Texas custody for more than twenty years and personally makes the terms make sense.
Many Buda parents are surprised that a Texas custody order is really a detailed allocation of parental rights and duties, not a simple label of who ‘wins’ the child.
Where a Buda child custody case is handled
Buda is in Hays County, so a custody suit (a ‘suit affecting the parent-child relationship’) is filed with the Hays County District Clerk at the Government Center in San Marcos, about fifteen minutes south. Many custody matters resolve by agreement before a contested hearing.
Conservatorship: joint vs. sole managing conservator
In Texas, a parent’s role is defined as a conservator, and the central question is how the rights and duties are divided. Texas law presumes that parents should be named joint managing conservators (JMC), sharing the major decisions about a child’s education, healthcare, and welfare — though joint conservatorship does not mean equal time and usually still designates one parent to decide the child’s primary residence. In some cases a court names one parent sole managing conservator (SMC), giving that parent the exclusive right to make key decisions; this typically happens where there is a history of family violence, absence, substance abuse, or a serious inability to co-parent. Understanding which arrangement fits your situation — and which specific rights matter most — is where a Buda custody case is really decided.
Which rights and duties matter most
Because a Texas conservatorship is a bundle of specific rights, a Buda custody case is often won or lost in the details rather than the label. The order spells out who decides where the child lives, who makes educational and non-emergency medical decisions, who manages the child’s finances, and how the parents must consult one another. Some of these rights can be held independently by one parent, some jointly, and some exclusively — and the right combination depends on your family. We help Buda parents focus on the rights that will actually shape daily life, rather than fighting over a title, so the final order is one you can live with and that genuinely serves your child.

Frequently asked questions
Does Texas use the word ‘custody’?
Not formally. Texas law uses ‘conservatorship’ and allocates specific parental rights and duties rather than a single custody label.
What is the difference between joint and sole managing conservator?
Joint managing conservators share major decisions; a sole managing conservator has the exclusive right to make key decisions, often where safety is a concern.
Does joint conservatorship mean equal time?
Not necessarily. It refers to decision-making rights; the time each parent spends with the child is set separately by a possession schedule.
Do I have to travel to your office from Buda?
No. Our office is in downtown Austin, about 15 miles north up I-35, and we handle most of a Buda custody case by phone and video.
